OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO JTG365 FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Indemnification

You agree to defend, indemnify, and hold harmless JTG365 and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the services or your violation of these Terms.

Dispute Resolution; Arbitration

Any dispute arising out of or relating to these Terms or the services shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in English in the State of Georgia, USA. You and JTG365 waive any right to a jury trial.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Force Majeure

Neither party shall be liable for any delay or failure to perform due to causes beyond its reasonable control, including acts of God, natural disasters, labor disputes, government actions, internet or telecommunications failures, or third-party service outages.

Severability; Survival

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Sections regarding intellectual property, disclaimers, limitations, indemnification, dispute resolution, and governing law shall survive termination.

Accuracy of Materials

The materials appearing on JTG365's website could include technical, typographical, or photographic errors. JTG365 does not warrant that any of the materials on its website are accurate, complete, or current.
